Some Important Things to Understand
After high-school graduation, students are no longer eligible for special education programs and services under the Individuals with Disabilities Education Improvement Act (IDEIA). Post-secondary institutions are governed instead by Section 504 of the Rehabilitation Action of 1973 and Title II, the American with Disabilities Act of 1990, which both prohibit discrimination based upon a disability. This means the responsibilities of post-secondary schools are different than high schools.
While in a public school system, it is the school districts responsibility to find and identify students with disabilities and it is their responsibility for conducting an evaluation. This is not the case in post-secondary schools and they have no responsibility to provide or pay for an evaluation. However, there is a requirement to consider accommodations resulting from a disability.
However, it is the responsibility of the individual seeking to attend a post-secondary institution to secure an evaluation that provides documentation of a disability and recommendations for appropriate accommodations. Each post-secondary institution governs its own decision-making and procedural processes and responsible for determining acceptable documentation and accommodations. It is also important to note that certain laws clarify that it is also not the responsibility of the prior public school system to provide or pay for a new evaluation or re-evaluation to document a disability and need for academic accommodations at a post- secondary institution.
